The Arbitration process is a major instrument that Local 342 utilizes to enforce the Collective Bargaining Agreement. Many times, even after the Union grieves a situation, the employer still will not comply with the grievance. Therefore the Union must go a step further and arbitrate the grievance.
Waldbaum’s - Local 342 won yet another arbitration case the other day, when a senior butcher was reinstated with back pay by an arbitrator! UFCW Local 342 had offered to settle the case before Keith Halpern left the company, and the answer was no. The company was determined this butcher stay fired. Not real smart- Break out your A&P scorecards, we are starting the year off in the Win column again.
Key Food Pick Quick - Local 342 successfully settled an arbitration hearing with Key Food Pick Quick on January 18th, getting the part time member 100% of what he was entitled to. The employer decided to play “chicken”, not believing Local 342 Representatives would go to the mat to stop the abuse of a part time worker! When the Union Rep discovered that the owner of Pick Quick was making the member work full time hours for many weeks in a row, thinking the Union would not find out, the Local 342 Rep filed for arbitration demanding the full time position and correct rate of pay for this part time member. Once the employer realized there was no way to win this case, the owner settled at the arbitration hearing for exactly what the Union was asking the arbitrator to order.
